Administrative Law and Litigation Against the State in Costa Rica

We defend you before public institutions and municipalities: administrative appeals, permits, proceedings and contentious-administrative litigation.

Dealing with the State and with municipalities requires knowledge of their procedures and deadlines. We advise you under the General Law of Public Administration (Ley General de la Administración Pública) and represent you before the contentious-administrative courts — the jurisdiction that hears lawsuits against the State — whenever your rights require it.

What we do for you

  • Administrative remedies: motions for reconsideration (revocatoria) and administrative appeals.
  • Municipal permits and business licenses (patentes), licenses and authorizations.
  • Defense in administrative and disciplinary proceedings.
  • Contentious-administrative litigation and interim measures.
  • Counsel to public servants in their employment relationship with the State.

Frequently asked questions

A public institution ruled against me. Can I challenge the decision?

In most cases, yes: through administrative remedies and, if necessary, before the contentious-administrative courts. Deadlines are short, so consult us as soon as possible.

How much time do I have to file an appeal?

Very little. Appeals against many administrative and municipal decisions must be filed within just a few business days of notification. If you received an unfavorable decision, contact us right away.

I filed a request and the institution has not answered. What can I do?

Public institutions are required to answer petitions within the time limits set by law. If they fail to do so, the request can be renewed and, depending on the case, a constitutional protection action (recurso de amparo) can be filed with the Constitutional Chamber of the Supreme Court.

My municipal permit or business license was denied. Can this be fixed?

Often, yes. We review the reasons for the denial and, depending on the case, we correct the requirements and resubmit the application or challenge the decision.
