When is a land dispute agrarian rather than civil?
When the property is used for a productive agrarian activity, such as cattle ranching or farming, the dispute usually falls under the agrarian jurisdiction. We determine this when we study your case.
I have possessed a farm for years, but it is not registered. Can I obtain title?
It may be possible through a possessory information proceeding (información posesoria), if you have held the land publicly, peacefully and continuously for the period required by law, generally ten years, and meet the other requirements. We review your case and the documents you have.
A neighbor moved the fence or is encroaching on my land. What should I do?
Gather the survey plan, the registry search and photographs. Depending on the situation, legal action can be taken to protect your possession or to establish the boundaries. Acting promptly prevents the situation from becoming entrenched.
Which agricultural contracts should be put in writing?
All of them: land leases, sharecropping, grazing agreements and contracts to buy crops or livestock. A clear written contract prevents most disputes between producers.
